1       Introduction

1.1     Declaration of pecuniary interests, significant non-pecuniary interests and less than significant non-pecuniary interests

The provisions of Chapter 14 of the Local Government Act, 1993 (the Act) regulate the way in which Councillors and designated staff of Council conduct themselves to ensure that there is no conflict between their private interests and their public role.

The Act prescribes that where a member of Council (or a Committee of Council) has a direct or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the Council (or Committee), that interest must be disclosed as soon as practicable after the start of the meeting and the reasons given for declaring such interest.

As members are aware, the provisions of the Local Government Act restrict any member who has declared a pecuniary interest in any matter from participating in the discussion or voting on that matter, and requires that member to vacate the Chamber.

Council’s Code of Conduct provides that if members have a non-pecuniary conflict of interest, the nature of the conflict must be disclosed. The Code of Conduct also provides for a number of ways in which a member may manage non pecuniary conflicts of interest.

Recommendation

It is recommended that Committee Members now disclose any conflicts of interest in matters under consideration by the Environmental Sustainability Policy Committee at this meeting.

2.1     Minutes of the Companion Animals Community Committee held on 5 July 2021

EXECUTIVE Summary

The minutes of the Companion Animals Community Committee held on 5 July 2021 are provided to the Environmental Sustainability Policy Committee for adoption.

Link To Delivery/OPerational Plan

The recommendation in this report relates to the Delivery/Operational Plan strategy “6.1 Live - Provide services and facilities that enable Council to fulfil its obligations under the Companion Animal Act”.

Within Companion Animals Community Committee budget and Special Contracts budget.

Recommendation

1          That Council acknowledge the reports presented to the Companion Animals Community Committee at its meeting held on 5 July 2021.

2          That Council determine recommendations {3.1,3.2,3.3} from the minutes of the Companion Animals Community Committee meeting of 5 July 2021.

3.1       That Council request the Traffic Committee to inspect the safety issue at Riawena Oval where vehicles are driving through from Ploughmans Lane to Kooronga Avenue.

3.2.1    That Council contact Google Maps to update the information in respect to Gosling Creek Reserve. This area is wrongly described as an off leash dog area.

3.2.2    That Council provide signage for the new off leash areas at North Orange, Lombardy/The Escort Way and Ridley Oval.

3.2.3    That Council nominate an area of off leash exercise space in the Shiralee subdivision.

3.2.4    That Council revisit Weily Park in Park Street Orange as a possible off leash area

3.3       That Council run an advertising campaign in regards to the registration of Companion Animals.

3          That the remainder of the minutes of the Companion Animals Community Committee at its meeting held on 5 July 2021 be adopted.

That the Minutes of the Meeting of the Companion Animals Community Committee held on 10 May 2021 (copies of which were circulated to all members) be and are hereby confirmed as a true and accurate record of the proceedings of the Companion Animals Community Committee meeting held on 10 May 2021.

 

 

3       Presentations

3.1     Committee member updates

TRIM Reference:        2021/1394

Neil Jones – completion of the Orange City Pound is a major achievement for Council. Cat controls need to be looked at in the city as there is still much to be done in this area. Good to see that Council is continuing to provide off leash dog parks.

Anne Reith – would like to see the desexing programs continue and education on the keeping of companion animals. The RSPCA has a free microchipping and vaccination day on the 25 September 2021.

Susan Sanders – raised information from a newspaper article from a person in Tamworth regarding cats and their behaviour and that the Companion Animals Act 1998 Section 31 (If an authorised officer of a council is satisfied that a cat is a nuisance, the officer may, after complying with Section 31A, issue an order in the approved form to the owner of the cat requiring the owner to prevent the behaviour that is alleged to constitute the nuisance )should be looked at in regard to change. There is a petition to change this Section 31.

Pam Davis – Congratulations on the construction of the Pound. There is still the issue of the placement of the bollards at Riawena Oval which was requested  last year.

3.2     Dog Exercise Parks

Discussion on what description appears on Google Maps for the Gosling Creek Reserve, it is now indicating that this area is off leash.

Signage is required at dog off leash areas and the map to be updated.

A vote of thanks was extended to Cr Nugent, Manager Building and Environment and Companion Animal Registrar for their input and time into the Companion Animals Community Committee

 

In reply Cr Nugent thanked the members of the Committee for their time and input. It has been an enjoyable committee with interaction between the community and staff being very important.
