1       Introduction

1.1     Declaration of pecuniary interests, significant non-pecuniary interests and less than significant non-pecuniary interests

The provisions of Chapter 14 of the Local Government Act, 1993 (the Act) regulate the way in which Councillors and designated staff of Council conduct themselves to ensure that there is no conflict between their private interests and their public role.

The Act prescribes that where a member of Council (or a Committee of Council) has a direct or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the Council (or Committee), that interest must be disclosed as soon as practicable after the start of the meeting and the reasons given for declaring such interest.

As members are aware, the provisions of the Local Government Act restrict any member who has declared a pecuniary interest in any matter from participating in the discussion or voting on that matter, and requires that member to vacate the Chamber.

Council’s Code of Conduct provides that if members have a non-pecuniary conflict of interest, the nature of the conflict must be disclosed. The Code of Conduct also provides for a number of ways in which a member may manage non pecuniary conflicts of interest.

Recommendation

It is recommended that Committee Members now disclose any conflicts of interest in matters under consideration by the Services Policy Committee at this meeting.

3       Presentations

3.1     Police Report

TRIM Reference:        2018/550

2017 saw a 3% increase in the number of road fatalities across NSW from 2016. As of the end of March 2018 there have been 96 fatalities, with 71 fatalities recorded during the same period last year.

RECOMMENDATION                                                                        Cr K Duffy/Cr G Treavors

That the Police Report be acknowledged.

3.2     Road Safety Issues

TRIM Reference:        2018/551

Ms Moffitt reported an ongoing concern regarding people with complex needs being safely transported. The issues include a perceived lack of legislation regarding safe restraint practices for people travelling in wheelchairs and the training and monitoring of any guidelines for correct procedures with commercial transport providers and disability organisations.

There was a discussion regarding the Passenger Transport Act 2014 and the extent to which this Act may provide appropriate guidelines.

There was a suggestion the Centre for Road Safety may be the appropriate agency to approach for up to date information regarding the guidelines in place for vehicle, driver training and compliance for safely securing passengers travelling in wheelchairs in vehicles. The Orange Cabonne Road Safety Officer will investigate this option.

RECOMMENDATION                                                                             Cr K Duffy/Ms E Griffin

1               That Committee members liaise with the Orange Cabonne Road Safety Officer to determine if a letter should be sent to Mr Phil Donato, Member for Orange, seeking improved safety protocols for passengers travelling in wheelchairs in private, funded and commercial vehicles.

2               That the information on Road Safety Issues be acknowledged.

Recommendation

1        That Council acknowledge reports presented to the Orange Regional Museum Committee at its meeting of 17 April 2018.

2        That Council determine recommendation 3.3 and 3.4 from the minutes of the Orange Regional Museum Committee held 17 April 2018.

3        That the remainder of the minutes of the Orange Regional Museum Committee held 17 April 2018 be adopted.

further considerations

Consideration has been given to the recommendation’s impact on Council’s service delivery; image and reputation; political; environmental; health and safety; employees; stakeholders and project management; and no further implications or risks have been identified.

sTAFF COMMENT

Council does not support the extension of opening hours of the Visitors Information Centre during daylight saving period to open at 8.30am. Council staff do support staying open longer at the end of the shift as visitors are still on the road while sunshine is available. As a result, staff have found from the 2017/18 daylight saving period that visitors to Orange are coming to the Visitor Information Centre after the present daily closing time. A review of budget requirements would need to be done before this could be implemented.

SUPPORTING INFORMATION

In March 2011, Orange City Council formed the Committee to focus on activities and commemorations to mark the centenary of World War I as it relates to Orange and district. In partnership with the community, the Committee has developed a wide-ranging program to commemorate those who fought, those who paid the supreme sacrifice, those who remained at home, and the legacy of war.

The Action Plan, which forms part of the minutes, details the initiatives that have been completed to date and provides a progress report for others. Additional details of the major projects undertaken by the Committee are attached to the minutes for information.

The major project for 2018 will be the recreation of a photograph showing Armistice celebrations outside the Old Town Hall in 1918. This is planned for Sunday 11 November 2018 and will incorporate the Remembrance Day ceremony.

In response to a request from Cr Kidd a timeline of early Anzac Day commemorations is also included for information.

Information on the history of ANZAC Day in Orange                   D18/27079

First observed in Orange in 1916. The Leader is digitised on Trove until 1921 and lists commemorations of Anzac Day from 1916 to 1921. I have not checked microfilms for subsequent years but there is every reason to believe that the city continued to observe the day. By the late 1920s ANZAC Day had been proclaimed a public holiday in all states and territories of Australia

·    In 1916

o The Salvation Army Band and the Orange Town Band took part in a procession through the streets, followed by a combined memorial service at the Australian Hall from 12.30 until 1.30pm

o Stores were closed between 12 and 2pm to allow people to attend the events
