1       Introduction

1.1     Declaration of pecuniary interests, significant non-pecuniary interests and less than significant non-pecuniary interests

The provisions of Chapter 14 of the Local Government Act, 1993 (the Act) regulate the way in which Councillors and designated staff of Council conduct themselves to ensure that there is no conflict between their private interests and their public role.

The Act prescribes that where a member of Council (or a Committee of Council) has a direct or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the Council (or Committee), that interest must be disclosed as soon as practicable after the start of the meeting and the reasons given for declaring such interest.

As members are aware, the provisions of the Local Government Act restrict any member who has declared a pecuniary interest in any matter from participating in the discussion or voting on that matter, and requires that member to vacate the Chamber.

Council’s Code of Conduct provides that if members have a non-pecuniary conflict of interest, the nature of the conflict must be disclosed. The Code of Conduct also provides for a number of ways in which a member may manage non pecuniary conflicts of interest.

Recommendation

It is recommended that Committee Members now disclose any conflicts of interest in matters under consideration by the Finance Policy Committee at this meeting.

EXECUTIVE Summary

Council can only assist other organisations financially (in cash or in kind) in accordance with section 356 of the Local Government Act 1993.

Council has in place a policy for donations to be made under section 356 of the Act and annually advertises for applications under this policy. Additional applications are received during the year. This report provides the most recently received requests.

Link To Delivery/OPerational Plan

The recommendation in this report relates to the Delivery/Operational Plan strategy “3.3 Our City – Recognise that members of the community will take different leadership pathways, the Council will support this growth and development through appropriate activities, initiatives and assistance”.

The recommendation in this report also relates to Delivery/Operational Plan strategy "11.3 Our Economy - Encourage training and skills development for a diverse and sustainable labour market".

Process for applications of the remaining budget allocation

A Council resolution is required to allocate funds to any external entity, including as a donation.

Applications are considered against the criteria outlined in the donations policies. There is an application form that should be submitted to commence the process of making a donation to another entity. The form contains details that informs Council that the donation aligns with the intentions the Council has established in the Community Strategic Plan.

Recommendation

1        That Council support the Orange Jobs Expo 2017 and that a sponsorship of $1,653.00 (ex GST) be made from Regional Enterprise Development - Skills and Training Project budget to cover the cost of venue hire of the Orange Function Centre.

2        That a donation of $100.00 (ex GST) be made from the Sports Participation Program to Jackson Willis for attendance at the Australian All-Schools Championships as a member of the NSW team.

3        That a donation of $250.00 (ex GST) be made from the Sports Participation Program to Rachel Hoey for attendance at Singapore-Malaysia as a member of the Hockey Australia's Country Senior Women's Team Touring Squad.

4        That the request for an in-kind-donation valued at $1,069.00 for the use of a water truck to the Orange Campdraft Club be declined as the general donations budget has been fully expended.

Event - Orange Jobs Expo - 22 November 2017

The aim of the event is to promote vocational education for job seekers and school students in Orange.

 

Donation Request

Donation of $1,653.00 to cover the cost of hiring the Orange Function Centre for this event.

 

Policy Status

The applicant is a corporation within Training Services NSW. It does training and expos. The donation policy does state that government departments and their agencies/representatives are ineligible to receive financial assistance from Council. However, as a number of entities will be engaged in this project because it is about jobs growth, it is recommended to Council to vary the policy and support this initiative in this instance.

Comment: Donation sought under Category 6 - Event/Major Promotion Sponsorship

The City of Orange has hosted job expos in the past and they were well attended by the region. In 2004, over 600 people participated in a jobs expo. The last Orange expo was held in 2015 and had over 100 exhibitors. A new organising committee has been formed and they have committed themselves to return the Orange Jobs Expo as an annual event.

The expo will be open to school students and to people seeking employment and career advice. Local education, training, business and industry will be showcased. The event is free.

Orange City Council will have a site at the Expo to inspire and recruit new interest for people wanting a career in local government. This will also assist with raising the profile of Orange City Council to a new younger audience.

Regionally, Bathurst and Dubbo both host Job Expos annually. They are supported and or are managed by these councils.

The annual campdraft will be held at Orange Showground on Friday, 10 November 2017 to Sunday, 12 November 2017. The nature of the event will cause dust.

 

Donation Request

$1,069.00 - use of Council's water truck twice a day on Friday, Saturday and Sunday.

 

Policy Status

Category 3 - Annual Donations are to be determined during the budget period.

 

Comment: Donation sought under Category 3 – annual donation

The application seeks that Council provide a water truck as the event will generate dust.

The event is over three days, two of which are the weekend. The estimated costs of the labour and equipment has been determined as $1,069. As the donations allocation has been fully expended, the donation is recommended to be refused.
