The provisions of Chapter 14 of the Local Government Act, 1993 (the Act) regulate the way in which Councillors and designated staff of Council conduct themselves to ensure that there is no conflict between their private interests and their public role.
The Act prescribes that where a member of Council (or a Committee of Council) has a direct or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the Council (or Committee), that interest must be disclosed as soon as practicable after the start of the meeting and the reasons given for declaring such interest.
As members are aware, the provisions of the Local Government Act restrict any member who has declared a pecuniary interest in any matter from participating in the discussion or voting on that matter, and requires that member to vacate the Chamber.
Council’s Code of Conduct provides that if members have a non-pecuniary conflict of interest, the nature of the conflict must be disclosed. The Code of Conduct also provides for a number of ways in which a member may manage non pecuniary conflicts of interest.
Recommendation It is recommended that Committee Members now disclose any conflicts of interest in matters under consideration by the Sport and Recreation Policy Committee at this meeting. |

EXECUTIVE Summary
The Australia Day Community Committee met on 11 January 2017, and the recommendations from this meeting are presented to the Sport and Recreation Policy Committee for adoption.
Link To Delivery/OPerational Plan
The recommendation in this report relates to the Delivery/Operational Plan strategy “10.2 Our Economy – Facilitate and support the attraction and development of events, festivals, venues and activities for residents and visitors, ensuring access and participation for older people”.
Financial Implications
Council has been advised that as a council included in the NSW Government’s merger proposals under consideration by the Office of Local Government since referral on 6 January 2016, Council must comply with the merger proposal period guidelines issued under S23A of the Local Government Act 1993.
The guidelines instruct Council it should expend money in accordance with the detailed budget adopted for the purposes of implementing the Delivery/Operational Plan for the 2015/16 year.
Any expenditure outside the adopted budget requires the identification of clear and compelling grounds and must be approved by Council at a meeting that is open to the public. The guidelines indicate the resolution of Council for increased expenditure must specify the reasons why the expenditure is required and warranted.
If increased expenditure is greater than $250,000 or 1% of the Council’s revenue from rates in the preceding year, whichever is the greater, Council is required to exhibit the increase to the budget and consider comments received.
Council must also avoid entering into contracts or undertakings where expenditure or revenue is greater than $250,000 or 1% of the Council’s revenue from rates in the preceding year, whichever is the greater, unless the contract or undertaking is as a result of a decision or procurement process commenced prior to the merger proposal period or where entering into a contract or undertaking is reasonably necessary for the purposes of meeting the ongoing service delivery commitments of the Council or was previously approved in the Council’s Delivery/Operational Plan.

EXECUTIVE SUMMARY
The Bicycling Community Committee met on 6 February 2017 and the recommendations from that meeting are provided to the Sport and Recreation Policy Committee for adoption.

The recommendation in this report relates to the Delivery/Operational Plan strategy “5.1 Our Community – Identify changing community aspirations and undertake community engagement and planning for the creation of open spaces, recreational facilities and services, recognising the special needs of older people and those with disabilities”.

Ms Alford advised that there appeared to be a lack of understanding and confusion within the cycling community with regard to how road related issues (eg pot holes in roads and damaged cycleways) should be reported to Council. The Committee was advised that the following methods were the most effective means of reporting issues to Council · Email Council – council@orange.nsw.gov.au · Telephone – 1300 650 511 · Council Website – www.orange.nsw.gov.au click on the “Report It” tab · Snap Send Solve – www.snapsendsolve.com Free app that allows people to easily report feedback to relevant authorities. The Road Safety Officer also inquired as to whether Council cycleways and cycle lanes complied with Austroads guidelines and Australian standards for cycling. The Committee was advised that all off road cycle paths have been built to the Austroad guidelines in effect at the time. There are currently no dedicated on road bicycle lanes in Orange with bicycle shoulder lanes and mixed traffic streets used instead. The delevopment of bicycle shoulder lanes and mixed traffic streets is expected to continue into the future with the Active Travel Plan recommending these in favour of dedicated on road bicycle lanes as they are less onerous and better suited to the Orange street system. This approach has been developed by Traffic Engineers in close consultation with the Austroads Guides and the NSW Bicycle Guidelines. |

A new Ride Orange website will be one of the actions from the Orange Active Travel Plan which is currently being redeveloped.
The site will provide a centralised destination for people searching for information about cycling in and around Orange as well as providing links to the various local cycling groups.
It is expected that a calendar of events will be included to provide detail on activities and events being conducted by local Clubs and Cycle groups.

Clubs continue to provide updates on their club sites and FB pages with centralised reference, link page.

Cycle Awareness |
The Committee has previously discussed ongoing concerns over the Community’s general lack of knowledge of road rules relating to cyclists and felt that cycle awareness needed to be improved.
Whilst the Committee agreed that the State Government should be undertaking a broad education and awareness program relating to the new laws, it was felt that it would be beneficial to take a proactive approach in the matter and consider opportunities for raising local awareness. |
The Cycle Towns program has minor funding for cycling awareness and education through use of social media and radio advertising. Council to consider using Amy Gillett Foundation messages for this purpose.

RMS Forum |
The 2017 RMS Forum will be held in Wellington on 22 March 2017 with the focus being on building cycling communities.
Members and cycle group representatives are encouraged to attend if possible.

2016 Bike Week |
Due to heavy rain, Bike Fest was postponed from September to December.
Unfortunately attendance wasn’t as good as the 2015 event however there was strong interest in the Try 2 Wheels program which was designed to introduce or reintroduce people of all ages to cycling.

Major Cycling Events |
2017 NSW Masters Road Championships – 22- 24 April 2017. Some changes to Criterium and Time Trial courses to make these events safer and easier to manage.
Newcrest Orange Challenge - 5 March 2017
Triathlon NSW Club Championships – 18 March 2017 – This event will be conducted at Gosling Creek Reserve and is expected to attract in excess of 1,000 participants and officials.
Orange Triathlon Festival – Event was planned to take place on 5 February 2017 however the Promoter cancelled when Orange secured the rights to host the NSW Club Championships. Council is now working with another Promoter to conduct the Orange Triathlon Festival (or similar event) in November 2017.
Women’s Only Challenge Ride –100km event conducted on Sunday, 8 October 2016 and received positive feedback from participants. Event likely to be conducted again in 2017.
Western Division Track Championships – Scheduled for 11 March 2017 at the Moulder Park Velodrome.
Ginja Ninja 250 - The Ginja Ninja was originally scheduled for Sunday, 27 November 2016 but was postponed to 5 February 2017 due to poor track conditions as a result of wet weather. Unfortunately the rescheduled event was also cancelled due to the forecast for extreme heat.
Mountain Bike Australia (MTBA) National Cross Country Series Double Header – Orange hosted this event at the Kinross Forest trails on 7 & 8 February 2017 which attracted 150 of the Australia’s elite riders. MTBA were very happy with the course and the support provided by Council (financial) and the Orange Mountain Bike Club (operational).
Inter School Cycling Carnival - Following on from the success of the 2016 Inter School Carnival which involved a number of local high schools, organisers are looking to expand the event to include schools from Orange, Bathurst and Dubbo. Event to be conducted in March 2017.

Velodrome |
With the increased usage of the Velodrome, the Committee discussed the need for the following:
· Additional bubblers · Improved shade · Track lighting for night training and competition
“Light It Up” – The Cycle Club has commenced a number of fundraising activities to raise funds for the installation of suitable velodrome lighting. At an estimated cost of $170K, the project will also require partnerships Council, State and/or Federal Government.

Lake Canobolas Mountain Bike Park |
Through funding sourced from hosting the National Cross Country Series, the Club is continuing to undertake track improvement works at the Lake Canobolas Mountain Bike Park.

Mt Canobolas Mountain Bike Proposal |
Council has written to the Minister for Environment and Minister for Heritage requesting an amendment to the Plan of Management to permit Mountain Biking within the Mt Canobolas SCA.
Important to note that Council is NOT seeking an approval of the concept design prepared by World Trail which was provided as an example of what could be achieved. Council has also met with the Minister for Trade, Tourism and Major Events and Minister for Sport to discuss the proposal.
Council awaits the response from the Minister for Environment.
Community member, Mr Robert Alford is coordinating a working bee at Mt Canobolas to target Ivy (environmental weed) which has continued to infest sections of the Mountain. Mr Alford has engaged with National Parks, local environmental groups and the Mountain Bike Club who have all committed to the working bee on Sunday, 19 February 2017. |

Cycleways – Improved on road cycleway markings have been undertaken along with the installation of new stabling at various locations throughout the City. Current works: · Tender for construction of rail underpass culvert near James Sheahan High School is about to be advertised. · Additional bike stabling to be installed including a bike shelter in the Council car park
Active Travel Plan - When complete, the Plan will guide the implementation and maintenance of active travel infrastructure and programs throughout the City and surrounding villages, with the aim of encouraging greater participation in active transport options. The Plan will address existing gaps and barriers across the cycle network.
Ride2School – Six local schools have signed up for the Ride2School Program. Bicycle Network will begin to implement the Program in late February 2017. |
Current status: Part A: Framework - Orange Active Plan adopted by Council Part B: Implementation – Plan being finalised between Council and consultants. Anticipate report being considered by Council in March2017.
