1.2     Declaration of pecuniary interests, significant non-pecuniary interests and less than significant non-pecuniary interests

The provisions of Chapter 14 of the Local Government Act, 1993 (the Act) regulate the way in which Councillors and designated staff of Council conduct themselves to ensure that there is no conflict between their private interests and their public role.

The Act prescribes that where a member of Council (or a Committee of Council) has a direct or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the Council (or Committee), that interest must be disclosed as soon as practicable after the start of the meeting and the reasons given for declaring such interest.

As members are aware, the provisions of the Local Government Act restrict any member who has declared a pecuniary interest in any matter from participating in the discussion or voting on that matter, and requires that member to vacate the Chamber.

Council’s Code of Conduct provides that if members have a non-pecuniary conflict of interest, the nature of the conflict must be disclosed. The Code of Conduct also provides for a number of ways in which a member may manage non pecuniary conflicts of interest.

Recommendation

It is recommended that Committee Members now disclose any conflicts of interest in matters under consideration by the Sport and Recreation Policy Committee at this meeting.

3.1     Wade Park Master Plan

EXECUTIVE Summary

This report recommends that Council adopts the Wade Park Master Plan following the community consultation process.

Link To Delivery/OPerational Plan

The recommendation in this report relates to the Delivery/Operational Plan strategy “5.1 Our Community – Identify changing community aspirations and undertake community engagement and planning for the creation of open spaces, recreational facilities and services, recognising the special needs of older people and those with disabilities”.

Financial Implications

The works identified in the Master Plan will be prioritised and considered in future Delivery/Operational plans. Council will also seek external grant funding to assist with the implementation of some elements of the Master Plan.

That Council adopts the Wade Park Master Plan including the amendments from the community consultation conducted in 2015.

The recommendation of this report has been assessed against Council’s other key risk categories and the following comments are provided:

Service Delivery

Future development to Wade Park will enhance the sporting and spectator attributes which have both an economic and tourism appeal.

Image and Reputation

Wade Park is considered to be one of the premier sporting arenas in regional NSW, to remain at this sophisticated level continued enhancement of player and spectator facilities is required. 

Stakeholders

Ensuring that stakeholders have been consulted and value added to the Master Plan process has been a principle objective of the planning process.

Projects

The redevelopment of Wade Park will be a significant project that will require budget allocation and significant project management. It is currently an unfunded project.

SUPPORTING INFORMATION

Council engaged the services of Ross Planning to develop a Master Plan for Wade Park in consultation with user groups and the wider community. In January 2012 Council received a draft Master Plan and due to preliminary discussions and investigations on possible sites for the establishment of a rectangular sporting complex, further consideration of the draft Master Plan was placed ‘on hold’.

During 2014/2015 Council re-engaged with user groups with the assistance of Ross Planning to review the draft Master Plan, amend and update as necessary. Following this review Council resolved to place the draft Wade Park Master Plan on public exhibition on the 15 July 2015:

1        That Council note the recommendations from the User Group consultation.

2        That the Draft Wade Park Master Plan – May 2012 be updated to reflect the User Group recommendations.

3        That the updated Wade Park Master Plan be placed on public exhibition for 28 days.

 

At the conclusion of the exhibition period Council received one submission from the Orange Table Tennis Association requesting consideration that the proposed cricket centre of excellence have the capacity to host their sport. A minimum floor area of 480 square metres would be required to host eight tables (current arrangements at Canobolas Rural Technology High School) plus 20 square metres of storage space for housing tables and equipment when not in use. The submission is attached for information.

During consultation with the Wade Park user groups the executive of Orange (Newstead) Bowling Club discussed the opportunity of developing bowling greens and associated facilities at Wade Park. The Club Chairman was advised of the opportunity to respond to the exhibition of the draft Wade Park Master Plan with the Club’s (Newstead) proposal. The Club was also advised that due to ‘the size of the required facility, the increased demand for parking this will generate and other demands for the site Council seeks to discuss other potential sites for the new facility.’ A submission was not received from Orange (Newstead) Bowling Club.

As reported to the Services Policy Committee meeting of 7 July 2015 during the consultation period Council has been in negotiations with Cricket NSW with regard to the development of regional cricket centre of excellence. This facility consists of a multipurpose indoor facility with the emphasis on being a centre for excellence for cricket training and sports development with the capacity to cater for other sporting interests. A development model has been presented by Cricket NSW for the facility with the inclusion of office space. Dependant on available funding the proposal has a number of variations to cater for Wade Park’s sporting and spectator needs.

The establishment of a ‘cricket centre for excellence and multipurpose facility’ is consistent with the draft Wade Park Master Plan prepared by Ross Planning.

SUPPORTING INFORMATION

The Bike Week sub-group of the Bicycling Community Working Party, Stephen Nugent, Jane Arnott, Allison Rodgers and Council staff developed a program for the Celebration of the Cycle event at the Moulder Park Velodrome on Sunday, 13 September 2015.

The event was supported by the bicycling clubs, bike stores, rotary, girl guides and Bissy Café.

The event was conducted between 10am and 2pm and included:

·        Penny Farthing display

·        Yoga for cyclists

·        Cycle skills


 

·        Mass Ride on Velodrome

·        Track racing

·        Human powered vehicle display

·        Police vs community Bike Soccer Game

·        Timed event – fast lap on a reasonably priced bike where participants each used the same bike. There were four categories, boy’s and girl’s junior event and men’s and women’s open event.

The day was well attended with positive media coverage and will be built on in future years.

Image and Reputation

The Orange Adventure Playground is a showpiece playground and its maintenance and appearance is a priority for Council.

Health and Safety

Any playground will have inherent risks to users however it is considered that there are no health and safety risks that stem from maintenance issues.

 


 

SUPPORTING INFORMATION

A number of concerns were raised at the Council meeting of 15 August 2015 relating to the Adventure Playground.

1     Condition of the playground, its equipment and potential safety issues

Council conducts a monthly inspection of its playgrounds from which works and repairs are noted and conducted. However given the matters raised last night an inspection has been completed by the Manager City Presentation. That inspection showed:

·        The structure appears to be sound with wear and tear evident now that it is over 12 years old

·        A number of areas that require maintenance were identified in the northern section of the playground. These relate mainly to split timber and some missing palings. A hose pipe covering to a chain climber requires replacement with potential pinch points occurring due to splits and tears. These items will be replaced and repaired over the coming week. Whilst obviously requiring attention none register highly on a risk assessment, been mainly from general wear and tear.

·        Overall the major components like swing pivots, swing seats, climbing equipment, bridges etc are in good order and well serviced.

2    Bins/rubbish management and cleaning of shelters and BBQ plates

·        Two bins per shelter have been placed out; previously it was one bin per shelter. Their use will be monitored on Mondays and additional bins will be placed out if necessary.

·        Additional signs requesting patrons to please clean the barbecue areas after use were installed on 23 September 2015.

Works

Council’s Building Maintenance Supervisor, Carpenter and Manager City Presentation inspected the site on Monday 21 September to implement a program of works to undertaken immediate repairs to timber work as identified during the visual inspection by the Manager City Presentation. Progress is currently being made in the repair and or replacement of worn timber components, for example balance beam platforms, deck surfaces, handrails and seats.

Minor maintenance activities recently undertaken to improve the presentation include the replacement of playground softfall that has spilt out of the playground back within the structure and the cleaning of autumn leaf fall debris that has accumulated in seating areas.

Future repairs will include the replacement of timber platforms/decks as the timber surfaces are weathering and showing signs of general wear. These works will be undertaken as part of the playgrounds maintenance program and will commence in November with timbers being replaced.

There are no foreseeable capital expenditure items either in the form of renewal or upgrades required within the next two years. However a number of items will be monitored eg the Liberty Accessibility Swing accessible surface for further wear and tear. This rubber wet pour surface is delaminating, with the brown rubber surface lifting away from the underlying black rubber. At present this does not pose a hazard to use.

Other works to be undertaken will be the replacement of the three tractor tyres in the junior section of the playground as these are showing signs of splitting and present possible pinch points. The tyres will need to be excavated and replaced when sourced from tyre repair businesses.

The playground is re-oiled on a biannual basis and is scheduled to be undertaken by the City Presentation team in early 2016.

SUPPORTING INFORMATION

During the week ending 20 September 2015 Orange hosted the Central Coast Mariners and the Newcastle Jets A-League football teams. The week’s events culminated in a football game on Sunday 20 September between the two teams at Wade Park. A crowd of 2145 spectators attended the match which has a 1 – nil score in favour of the Jets. Within one hour of the match kick-off a heavy down pour struck Orange; however by match kick-off the reports from team officials were that the ground was perfect for match conditions. This rain event is known to have deterred spectator groups such as families with young children and therefore an impact on the spectator numbers attending resulted.

During the week preceding the Sunday match football clinics were conducted at Sir Jack Brabham Park and at Waratah Sports Ground. With 80 and 120 (respectively) youth participating in these clinics. A Coach the Coach clinic was also undertaken at Waratah Sports Ground with a considerable number of coaches attending this activity. School clinics were also conducted across the region in the lead up week.

The Mariners participated in a ‘warm up game’ against the Western Mariners in the evening of Thursday 17 September at Wade Park in front of a crowd of some 500 spectators.

The lasting legacy for the youth, football coaches and spectators of hosting A-League teams in the region has many intangible benefits on a social, personal and sports development aspect.

It should be noted that the Central West Rugby grand final match was played on Saturday 19 September at Endeavour Oval where a crowd of 2500 attended. Other factors influencing the spectator numbers for the A-League match were that the game was played on the first weekend of the NSW School Holidays and that confirmation of Wade Park hosting the game was received only 4-5 weeks prior and therefore promotional and sponsorship opportunities were limited.

Football, whilst played by over 2000 individuals in Orange, is continuing to develop a profile at the national competition standard (A-League) in regional NSW. A team affiliated supporter based continues to be gathered by A-League Clubs in regional areas and the continued support of Council in hosting elite football sporting events is a key element to this continued market growth.

In summary, the event cost Orange City Council in the order of $34,000, with $25,000 of that funding going direct to the Central Coast Mariners. In addition to the direct payment to the Mariners, security, promotional and staff costs (ground preparation) were incurred. With ticket sales $14,545 being receipted, the net cost to Council for hosting this event was $19,455. As previously mentioned, for past elite sporting events Council has gained market sponsorship which has assisted to ‘off set’ the costs of hosting sporting events. However on this occasion, with the short lead time, it was determined that adequate sponsorship value could not be gained to provide the sponsor with enough significant exposure to warrant engaging with a sponsor. 

The intangible benefits across the broader community of hosting elite sports events/persons and the exposure that this provides to Orange, the Orange Region, Food and Wine etc, to area of origin supporter base should not go unrecognised for capacity building and assisting with future bids to host like events in the future. Orange continues to establish a recognisable market place amongst the sporting community for hosting quality events on well prepared playing fields.
