1       Introduction

The provisions of Chapter 14 of the Local Government Act, 1993 (the Act) regulate the way in which Councillors and designated staff of Council conduct themselves to ensure that there is no conflict between their private interests and their public role.

The Act prescribes that where a member of Council (or a Committee of Council) has a direct or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the Council (or Committee), that interest must be disclosed as soon as practicable after the start of the meeting and the reasons given for declaring such interest.

As members are aware, the provisions of the Local Government Act restrict any member who has declared a pecuniary interest in any matter from participating in the discussion or voting on that matter, and requires that member to vacate the Chamber.

Council’s Code of Conduct provides that if members have a non-pecuniary conflict of interest, the nature of the conflict must be disclosed. The Code of Conduct also provides for a number of ways in which a member may manage non pecuniary conflicts of interest.

Recommendation

It is recommended that Committee Members now disclose any conflicts of interest in matters under consideration by the Environment and Economic Development Policy Committee at this meeting.

EXECUTIVE Summary

The Environmental Sustainability Community Committee met on 19 December 2014 and the recommendations from that meeting are presented to the Environment and Economic Development Policy Committee for adoption.

Link To Delivery/OPerational Plan

The recommendation in this report relates to the Delivery/Operational Plan strategy “12.1 Our Environment – Ensure the Plans of Management for the City’s natural resource assets are current and reviewed”.

Financial Implications

Funding for a biodiversity study in the 2015/16 Delivery/Operational Plan will need to be raised as an initiative in the budget preparation processes.

Recommendation

1        That the recommendations made by the Environmental Sustainability Community Committee at its meeting held on 19 December 2014 be adopted.

2        That the Environmental Sustainability Community Committee 2015 meetings be held on 20 February, 15 May, 21 August and 20 November to avoid the busy month of December.

SUPPORTING INFORMATION

At this meeting the Committee recommended to support Council in its efforts to ban smoking in the CBD between Five Ways to Hill Street and Kite Street to Byng Street. The Committee noted the potential difficulty of enforcing such a ban and acknowledges that any ban on smoking in the CBD is more about engaging with the community to seek its support to provide peer pressure as has happened at community facilities including playgrounds to achieve a change of behaviour in a collaborative manner rather than through regulatory enforcement measures.

The Committee recommended that Council considers in its 2015/16 budgetting process appropriate allocation of funding towards the preparation of a biodiversity study (plants and animals of the Orange region) in collaboration with Charles Sturt University and other potential partners. This will be considered in the preparation of next Delivery /Operational Plan.

GUEST SPEAKERS: ADAM KING AND MARY MALIN, DEPARTMENT OF PRIMARY INDUSTRIES – “BIOSECURITY INFORMATION SYSTEMS”

Adam King and Mary Malin (DPI) introduced the Biosecurity NSW System in place and administered by Department of Primary Industries.

The Biosecurity Information System, BioMaps and Biosecurity Intelligence Reporting System were outlined.

The goal is to build a biosecurity profile for NSW that enables on the ground biosecurity situational awareness for emergency and operational use.

Weeds, feral animals and other natural resource biosecurity risks are all aimed to be managed via an integrated approach by professional DPI Officer research and mitigation processes.

3       Presentations

3.1     Gap Analysis Priority Action List - Energy Sub-Group

TRIM Reference:        2014/2438

The Manager Water Treatment outlined that the Energy Sub-Group has met twice with an emphasis on education of efficient use of energy and renewables/incentives. Research on how Council can promote energy awareness issues to the general public is being undertaken and Council’s media team will be working on how best to do this.

Training through the Office of Environment and Heritige to Council staff, small to medium enterprises and the communtiy will be offered from 10 and 11 March 2015.

3.2     Gap Analysis Priority Action List - Pollution/Waste Sub-Group

Cr Jones advised of the three meetings held by the Sub-Group and its relevance to the ESCC Gap Analysis document with future emphasis to be on completing the “Resources” column of “Who” and “Cost” associated with completing the issues identified.

3.3     Gap Analysis Priority Action List - Biodiversity Sub-Group

TRIM Reference:        2014/2439

Mr Kennedy advised of the three meetings convened by the Sub-Group to arrive at the draft action list presented. The key issue identified by the group is how can Council and the community become informed about the needs of our plants and animals being appropriately identified, protected and managed.

Cataloguing all existing biodiversity data and baseline information is the number one prioriy for this sub-group and is supported by the ESCC including indentifying the appropriate budget to coplete this key action.

3.1     Verbal report - Timaru

There has been no further action from Timaru. Emails have been sent out but no replies. Cr Gryllis will seek the assistance of Manager of Corpoate and Community Relations to make a phone call to his counterpart in Timaru.

3.2     Verbal report - Mt Hagen

TRIM Reference:        2014/2186

There has been no decision on the position of Lord Mayor. Orange City Council has provided some funds for an event to celebrate the 30 year anniversary of the Sister City relationship, potentially in April 2015. This may also be in conjunction with a celebration of 40 years of independence from Australia.

Cr Turner enquired if there has been any progress on the repair of the garbage truck. The current condition is unknown.

Mr J Hort updated the Committee on the status of the trainee project. The Department of Immigration and Border Control require new letters of offer to be sent to the trainees. These need to be lodged with the Department, along with new resumes. Once the trainees are in Australia, it is possible to teach them some hydraulics troubleshooting to allow them to attempt to repair the garbage truck in Mt Hagen.

3.3     Verbal report - Ushiku

Council has received a request from Ushiku for the Mayor of Orange to send a letter of seasons greetings and wishes to the Mayor and people of Ushiku.

There have been a number of school visits to Ushiku this year. The Committee have requested if it is possible to follow up with the visiting schools to get a one page report sent to the Committee.

3.4     Verbal report - Orange (California)

Cr Gryllis received an email from Orange City (California) requesting a letter from Orange City Council (NSW) as per report 2014/2184 (included in Agenda).

Cr Gryllis also advised the Committee that there have been visitors from Orange (NSW) go to Orange (California) and they have been warmly received.
