1 Introduction
1.1 Declaration of pecuniary interests, significant non-pecuniary interests and less than significant non-pecuniary interests
The provisions of Chapter 14 of the Local Government Act, 1993 (the Act) regulate the way in which Councillors and designated staff of Council conduct themselves to ensure that there is no conflict between their private interests and their public role.
The Act prescribes that where a member of Council (or a Committee of Council) has a direct or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the Council (or Committee), that interest must be disclosed as soon as practicable after the start of the meeting and the reasons given for declaring such interest.
As members are aware, the provisions of the Local Government Act restrict any member who has declared a pecuniary interest in any matter from participating in the discussion or voting on that matter, and requires that member to vacate the Chamber.
Council’s Code of Conduct provides that if members have a non-pecuniary conflict of interest, the nature of the conflict must be disclosed. The Code of Conduct also provides for a number of ways in which a member may manage non pecuniary conflicts of interest.
Recommendation It is recommended that Committee Members now disclose any conflicts of interest in matters under consideration by the Sport and Recreation Policy Committee at this meeting. |

EXECUTIVE Summary
Councillors were recently provided with a copy of correspondence and commentary on the direction of a BMX Club in Orange and provided an outline of the facility requirements for the BMX Track. This report provides Council with options for the BMX Track – Anzac Park.

The recommendation in this report relates to the Delivery/Operational Plan strategy “1.2 Live - Maintain and renew recreational spaces and infrastructure to encourage an active and healthy lifestyle”.
Financial Implications
Should Council adopt the recommendation to conduct ongoing maintenance, the annual cost would be $16,000 to $21,000.

That Council resolves: 1 That the BMX Track be retained and maintained for recreational use only subject to future alternative uses. 2 That Council consider the cost of the ongoing maintenance of the BMX Track in the 2019-2020 Delivery/Operational Plan; and 3 That future capital works to bring the BMX Track to competition standard only be considered by Council if grant funding can be obtained and that its operation can be supported by a vibrant, active and sustainable Orange BMX Club.

Consideration has been given to the recommendation’s impact on Council’s service delivery; image and reputation; political; environmental; health and safety; employees; stakeholders and project management; and no further implications or risks have been identified.
SUPPORTING INFORMATION
There is, in essence, little formal BMX Club activity in Orange and reduced volunteer capacity to operate a club or conduct track maintenance, such as we see with the Orange Mountain Bike and the Orange Cycle Club.
There remains however some demand to join a BMX Club with queries at this point being directed to the Bathurst BMX club – see https://www.facebook.com/Bathurst-BMX-Club-593699610672108/ - who conduct weekly club events and other events.
The future of BMX in Orange is difficult as the current facility is not ridable in its condition and as a result there is little interest and desire from the community to reinvigorate the Orange BMX club.
BMX TRACK UPGRADE
The BMX Track was upgraded in conjunction with significant volunteer input from the Orange BMX Club in 2015 - 2016 with a new design that met BMX Australia & UCI specifications to allow scope for hosting National & UCI level BMX events.
To enable the facility to be used for these events, the track also required sealing of a section of the start hill, installation of the start gates and ongoing maintenance of berms and the track.
The BMX Club at the time (2016) were conducting fundraising events to raise the funds for these works to be completed. Due primarily to health issues of members within the club, this was not completed.

MAINTENANCE REQUIRED
Maintenance required for the facility to a level that enables riding at club level requires the management of weeds and plant growth and the maintenance of the riding surface.
The estimated cost to maintain the surface annually is $6,000 being the cost of machinery 6 times a year to remove ruts and wash.
The weeds management requires a regular program of spraying and minor maintenance which is estimated at a cost of $10-15,000 per annum.
The conduct of this level of maintenance is ordinarily provided by volunteers who use a facility, however given the current circumstances would fall to Council.
These works would enable the facility to be utilised in a safe manner but would not support the conduct of events.
CAPITAL WORKS REQUIRED
To enable the facility to be used for events requires the installation of:
• Barrel start gate
• Full concrete start hill
• Stabilised berms with a polymer to reduce erosion
• Stable track
The estimated cost for these works is approximately $50k to $80k.
Additional facilities that could be considered for the site are:
• Shade for start hill
• Shade for spectators (either built or trees)
• Storage/canteen area
• Seating
• Toilets
• Water
• Power
The cost for these elements are approximately $150k to 200k
OTHER USES FOR BMX SITE
Council developed a master plan for Anzac Park in 2014 which included the retention of the BMX Track facility.
The master plan also identified zones for:
· Expansion to existing Sir Neville Howse Stadium building for additional indoor netball/basketball court and seating.
· Outdoor netball court expansion
· Skate park (completed)
· Amenities for users (additional)
The current utilisation and future needs of the site does not necessitate the removal of the BMX facility and it is recommended that it be retained for recreational use subject to identified needs for other uses.

EXECUTIVE Summary
With an approximate value of over $5,000,000 annually, Council’s Major Sporting Event Attraction Program continues to deliver strong economic outcomes for the City.
The purpose of this report is to provide an overview of the sporting events Council has attracted to Orange during the 2018/2019 financial year and provide an update on events already secured for 2019/2020.

SUPPORTING INFORMATION
As is now widely recognised, sport and more specifically sporting events are no longer just about recreation. In commercial terms, sporting events offer economic, social and community opportunities to the regional destinations that are prepared to recognise and take advantage of them.
Events attract visitation, which results in significant cash inflow into the local economy. Sport provides the basis for public and private infrastructure development; it attracts investment, builds social capital and provides opportunities to impress sport specific visitors, which leads to return visitation.
To ensure Orange was well positioned to secure a greater market share of sporting events, in March 2008 Council; with strategic support from Sports Marketing Australia initiated the Major Sporting Event Attraction Program to promote the City’s sporting organisations and facilities to governing bodies and other event owners.
This Program continues to be extremely successful in attracting a large number of state and national level events to Orange on an annual basis. 2018/2019 has been another positive year for the Program with 15 major events being hosted in Orange which attracted over 11,000 visitors.
The table below is a list of major sporting events that Council has played a role in attracting to Orange and/or provided significant resources to assist in staging of the event.

Whilst it is difficult to calculate the true value of each event due to variances in the participant and accompanying partner demographics; based on Tourism Research Australia figures of $274 per person per night, it is estimated that the events hosted in Orange during the 2018/2019 financial year have injected over $5.2M into the local economy.
As will be noted in the table below, Council has already locked in a further 13 events for the 2019/2020 period with a number of these being new events that have not been previously conducted in the region.
Council would be aware that a bid was recently put to Hockey Australia to host the month long Australian Festival of Indoor Hockey in January 2020 however Council has recently been advised that this bid was unsuccessful on this occasion however there will be further opportunities to host this event in the future.
Council is also working through a number of other event opportunities across a variety of sports for the 2019/2020 period and beyond.
