1       Introduction

1.1     Declaration of pecuniary interests, significant non-pecuniary interests and less than significant non-pecuniary interests

The provisions of Chapter 14 of the Local Government Act, 1993 (the Act) regulate the way in which Councillors and designated staff of Council conduct themselves to ensure that there is no conflict between their private interests and their public role.

The Act prescribes that where a member of Council (or a Committee of Council) has a direct or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the Council (or Committee), that interest must be disclosed as soon as practicable after the start of the meeting and the reasons given for declaring such interest.

As members are aware, the provisions of the Local Government Act restrict any member who has declared a pecuniary interest in any matter from participating in the discussion or voting on that matter, and requires that member to vacate the Chamber.

Council’s Code of Conduct provides that if members have a non-pecuniary conflict of interest, the nature of the conflict must be disclosed. The Code of Conduct also provides for a number of ways in which a member may manage non pecuniary conflicts of interest.

Recommendation

It is recommended that Committee Members now disclose any conflicts of interest in matters under consideration by the Finance Policy Committee at this meeting.

EXECUTIVE SUMMARY

Council can only assist other organisations financially (in cash or in kind) in accordance with section 356 of the Local Government Act 1993.

Council has in place a policy for donations to be made under section 356 of the Act and annually advertises for applications under this policy. Additional applications are received during the year. This report provides the most recently received requests.

The recommendation in this report relates to the Delivery/Operational Plan strategy “15.2 Collaborate - Support community organisations and groups to deliver services and programs”.

1   $3,800.00, has been put back into general donations (being the remaining balance of the School Prize Giving Fund). $5,000 has been transferred out of general donations to fund the wood and heating bank vouchers program. $750.00 has been put back into general donations (being a returned donation from the Orange Schoolhouse Quilters, as their event was not held).


 

 

2   Includes $10,000.00 from City Events and $2,500.00 from Economic Development. In August 2018, an amount of $1,500.00 was returned to Major Promotions. The Rotary Club of Orange Daybreak will not now be holding its Classic Wines and Cars Expo in 2018 as the event will now be a biennial event and the next one will be in late 2019.

3   Emergent funding is allocated as $5,000.000 per quarter in the financial year:

Quarter 1 starts on 1 July and has been fully expended for this financial year;

Quarter 2 starts on 1 October and has been fully expended for this financial year;

Quarter 3 starts on 1 January and has been fully expended for this financial year;

Quarter 4 starts on 1 April and $3,132.03 has been expended so far in this financial year.

Process for applications of the remaining budget allocation

A Council resolution is required to allocate funds to any external entity, including as a donation.

Applications are considered against the criteria outlined in the donations policies. There is an application form that should be submitted to commence the process of making a donation to another entity. The form contains details to inform Council that the donation aligns with the intentions the Council has established in the Community Strategic Plan.

Recommendation

The Council resolves:

1        That the request for financial assistance from the Wentworth Golf Club be declined.

2        That a donation of $100.00 be made to Ainsley Holmes from the Sports Participant Program (selected in the NSW Country Development Team).

3        That a donation of $1,000.00 be made to the Orange Waratah Soccer Football Club from General Donations (visit by Ex-Socceroo, Paul Wade).

4        That a donation of $500.00 be made to Jasper Mihalich from General Donations (selected in the Sydney Youth Orchestra Flagship Ensemble).

5        That a donation of $250.00 be made to Cody Burcher from the Sports Participant Program (ranked to go to the Australian Formula Ford Championships).

6        That a donation of $500.00 be made to Michelle Stevenson from the Sports Participant Program (selected as the Manager of the Australian Indoor Over-40s Master Hockey Team).

Consideration has been given to the recommendation’s impact on Council’s service delivery; image and reputation; political; environmental; health and safety; employees; stakeholders and project management; and no further implications or risks have been identified.


 

SUPPORTING INFORMATION

Council has $3,800.00 remaining in General Donations and $ remaining in Emergent Funding. Sports participation applications are considered in line with the reserved budget for that category.

 

Applicant 97

Wentworth Golf Club

Evidence not provided.

Purpose of the Request

Removal of displaced vegetation from the course.

Amount Requested

The estimated cost, based on the amount of material on site as at 4 January 2019, to load and cart vegetative debris from Wentworth Golf Club to the Resource Recovery Centre, Ophir Road and pay for tipping fees is: $941.75 (plant and labour) and $354.00 (tipping fees). This totals $1,295.75.

Policy Category

The applicant is applying for an in-kind donation under General Donations. This is not an in‑kind donation as it is attracting costs. It comes under Miscellaneous (projects), which has a maximum donation level of $2,000.00.

Comment and Recommendation

This does not meet the criteria of being a community project. It is operational costs for a golf club that raises its own funds through membership fees, green fees and the operation of a restaurant and bar.  The Club has the capacity to generate funds from its commercial activities from its customers or through financial members who are the beneficiaries of the Club’s activities.  This request is not supported.

The applicant has been selected in a regional sporting team - the NSW Country Development Team and will be attending the NSW Country Basketball Championships in Newcastle on 6-9 January 2019. (NB This application was received before this event.)

Orange Waratah Soccer Football Club

Purpose of the Request

A visit to Orange by Ex-Socceroos Captain, Paul Wade, to help promote the sport of soccer at all levels, including transition from juniors to seniors. It is particularly hoped to encourage girls and women to continue playing the sport and to strengthen the future of soccer in Orange.

Comment and Recommendation

Orange Waratah Sports Club is the host club for various sports clubs that use its grounds. Council provides financial assistance to the host club for grounds maintenance and the Club generates income from the operation of a club house and other sources.  However, the smaller clubs using the grounds, such as the applicant, do not appear to have an entitlement to funding from the host club for this activity. This application is therefore eligible for consideration.  This request is supported with a recommendation donation of $1,000.00.

The applicant has been selected to tour the United Kingdom as a member of the Sydney Youth Orchestra Flagship Ensemble.

General - Donations - Miscellaneous, which has a maximum donation level of $2,000.00.

Comment and Recommendation

Community groups, not individuals, are supported under General Donations. However, this donation is similar to reaching a sports-representation level (where donations can be made to individuals) and would equate to "selection in a State team", which has a maximum donation level of $500.00.  This request is supported with a recommended donation of $500.00.

Purpose of the Request

The applicant has been ranked in the sport to be able to attend the Australian Formula Ford Championships. This request relates to the rounds in April 2019.

Comment and Recommendation

This sport does not align to the categories for being selected in a representative team but the applicant has received very high achievements in this sport over a long period and is an excellent ambassador for Orange when he does his sport.   In the Sports Participant Program, competing in Nationals for this applicant is similar to the level of being selected in a State team to go to Nationals. This request is supported with a recommended donation of $250.00.

The applicant has been selected as the Manager of the Australian Indoor Over-40s Masters Hockey Team. This team will compete at the World Cup Indoor Masters in Hong Kong on 11-17 February 2019.

Sports Participants Program - Selected in a National Team, which has a maximum donation level of $500.00.

Comment and Recommendation

While selection as an official for a representative team is not expressly provided in the donations policy under the Sports Participant Program, the request is very similar to an athlete being selected in a National Team and the applicant is subject to similar costs at her own expense. It is our view that the application is consistent with the intention of the Policy to support participation by Orange residents in regional, national and international sporting events and therefore it is open to the Council to support the application.  This request is supported with a recommended donation of $500.00.
